Dear Ms. Gooch:

On behalf of the Biotechnology Industry Organization (BIO), on October 14, 2008, I provided oral comments on the above-referenced proposed rule at the Oregon Department of Agriculture Building in Salem. At that time, I provided a written copy of my comments, and am also attaching a copy of those comments to this letter for your reference.

When I arrived in Salem to offer my comments, I, along with the others present, was informed by an official from the State Department of Agriculture that the State Department of Justice had raised concerns regarding the proposed rule. Due to these concerns, the Department of Agriculture was withdrawing the proposed rule, and it is no longer under consideration for finalization at this time. For that reason, BIO is not supplementing my earlier comments in this letter. If, however, my understanding regarding the withdrawal was in error, BIO reserves its right to provide further comment on the proposed rule at a later date.
